Seven's Heaven Conditions
Conditions with regard to purchased material from the Sevensheaven website
1. Conditions
Please carefully read through these conditions before you order material from the Sevensheaven website. If you agree with the conditions, you will confirm this by clicking the "Finish" button in the order page.
2. Confidentiality
The data you enter will not be abused, for example by providing the data to third parties.
3. Intellectual property
All rights regarding the provided material and the designs therein are the intellectual property of Seven's Heaven, based upon the international copyright. Providing the image to a third party without written consent of Seven's Heaven is prohibited and punishable by international law.
4. Non-exclusive usage license
After purchasing material from the Sevensheaven assortment you will be granted a non-exclusive one time usage license regarding the purchased material, under the following conditions.
4.01 The item you have ordered is intended for single usage in a publication of your choice. It is not allowed to reuse the provided material in any way, unless you pay for it again.
4.02 The provided material may be used on a network or multi-user system with a maximum of 20 computer workstations at once. The material may only be used on computers under your supervision.
4.03 The provided material is not allowed to be modified in any way without prior written consent of Seven's Heaven.
4.04 The use of the under license provided material for personal, non-commercial use is allowed.
4.05 The license includes the permission for onetime use of the material for common applications such as presentations, sketches, designs, advertisement material, publicity material, brochures, publications, sales presentations, marketing and every other lawful type of use. Not allowed without written consent of Seven's Heaven is:
- the use of the provided material for commercial identity establishment, such as a company logo;
- commercial exploitation of the provided material, including selling / licensing the material to a third party and selling items that include the material, such as books, merchandise, apparel, software, consumer products, etcetera.
In case there is any doubt with regard to permitted use, then contact Seven's Heaven for verification.
4.06 The provided material may not be used in connection with or used during production of pornography, obscene statements, discriminating statements, offensive statements or other statements that might affect the honor or the reputation of the author.
4.07 The distribution of sublicenses is not allowed and the license is not liable for transfer. This means you are only allowed to use the provided material yourself and it is not allowed to hand the material over to others, either paid or unpaid, or to resell the provided material to others for any purpose.
4.08 It is not allowed to publish the material online in dimensions larger than standard world wide web image dimensions.
4.09 Along with publishing the material you are obliged to mention "Sevensheaven" or "Metin Seven" as the author of the work, thus respecting the author's right to have his name mentioned along with his work, according to international copyright law.
4.10 As a user/licensee you are responsible and liable for the use of the provided material, according to the conditions that are present in this document. You preserve Seven's Heaven from third-party claims.
5. Duration of the contract
Usage of the provided material is allowed for a maximum period of two years in one single edition or implementation of a publication of your choice. The usage rights expire immediately and without the need for any warning or summoning from our side in case you do not comply with the conditions mentioned in this document. In case of a premature termination of the license you are obliged to destroy all the material that is related to the terminated license, including all created copies, including copies created on harddisk or other storage media, and to confirm this in writing (which includes e-mail) to Seven's Heaven.
6. Warranty and restriction of liability
The purchased material will be provided in the ordered specifications after payment of the licensing fee. Seven's Heaven is not liable for shortcomings that occur in the provided material during the digital shipment to your computer. Each liability with regard to damage as a result of shortcomings in the fulfillment of our obligations is expressly out of the question.
7. General provisions
This Agreement will be governed under the national laws of the Netherlands applicable therein (without reference to conflicts of laws principles). Disputes that may rise as a result of this agreement will first be attempted to be settled amicably.
